Terms of Service
Effective date: June 3, 2026
Last updated: October 23, 2026
These Terms of Service ("Terms") govern your access to and use of the Sportified App, Sportified HQ, Sportified PaceLabs, the Sportified website, and their related services (collectively, the "Service") operated by Sportified ("Sportified," "we," "us," or "our").
The App supports individual and organization coaching, session delivery and supported companion-device features. HQ supports organization operations and programming. PaceLabs supports authorized content importing, authoring, testing, review and publication. Your access to particular products and features depends on your account, role, permissions and plan.
By creating an account or using the Service, you agree to these Terms. Our Privacy Policy explains how personal information is handled across all of these products. If you do not agree to these Terms, do not use the Service. Acceptance of these Terms does not replace any separate consent required by applicable law.
1. Eligibility and accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to create a coach, administrator, staff or PaceLabs contributor account. You must be authorized to act for an Organization when using its workspace. Any supported guardian or participant access must follow the authorized invitation process and any applicable consent requirements. PaceLabs access is restricted to authorized contributors; an invitation does not grant authority to publish outside your permitted scope.
You are responsible for:
- Providing accurate registration information
- Maintaining the confidentiality of your credentials
- All activity under your account
- Notifying us promptly of unauthorized access
We may suspend or terminate accounts that violate these Terms or pose a security risk.
2. Organization relationships
If you use the Service through a sports organization, club, or school ("Organization"), your Organization may control team data, roster information, and user invitations. The Organization is responsible for its compliance with laws applicable to athlete data and for obtaining necessary consents from guardians and athletes.
Coaches and staff access teams according to assignments made by the Organization. Access does not transfer if you leave an Organization unless explicitly reassigned.
HQ administrators are responsible for assigning appropriate permissions, reviewing invitations, and handling people, roster, emergency-contact and billing information only for authorized purposes. Imported CSV files and content must be accurate, lawfully obtained and appropriate for the intended workspace.
3. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, or fraudulent purposes
- Upload content that infringes intellectual property or privacy rights
- Attempt to bypass security, access controls, or rate limits
- Reverse engineer, scrape, or interfere with the Service except as permitted by law
- Harass, abuse, or endanger athletes, guardians, or other users
- Share login credentials or impersonate another person
- Use the Service to store or transmit malware or unauthorized surveillance
We may investigate violations and cooperate with law enforcement where appropriate.
4. Coaching content and AI features
The Service allows creation and delivery of training sessions, drills, videos, diagrams, notes and AI-generated suggestions. PaceLabs also supports content imports, generation, editing, review and publication. AI outputs are assistive only. You are responsible for reviewing all AI-generated content before use or publication and ensuring it is accurate, safe, age-appropriate and suitable for your participants, equipment and facility.
App and HQ customer PACE planning uses group-level coaching configuration and exercise catalogue content with Amazon Bedrock. Customer-entered practice titles remain saved in Sportified but are excluded from PACE AI summary requests. Account and participant identifiers, contact details, roster records, medical notes, coach notes and debriefs are not inputs to this customer planning flow.
A successful generation, validation check, review status or publication action is not a guarantee of safety, factual accuracy, originality or intellectual-property clearance. Contributors must verify source rights, attribution, diagrams, progressions and instructions. Do not provide confidential or sensitive personal information to an AI feature without lawful authority. The Privacy Policy describes the providers and data involved.
Sportified does not guarantee that exercises, lesson plans, or AI recommendations are error-free, medically appropriate, or suitable for every participant. Consult qualified professionals for medical, safety, or legal questions.
5. Athlete health and safety
Health restrictions, medical notes, and emergency contacts may be stored to support safe coaching. Organizations and coaches must keep this information accurate and use it responsibly. The Service is not a medical device and does not provide medical advice.
6. Guardian and minor accounts
Where the Service involves minors, the account holder must obtain lawful authority and any legally required participant or parental consent before entering or using their personal information. This includes verifiable parental consent where applicable under COPPA or other law. Guardians must have authority to act for the child.
A roster record may be created before a guardian courtesy notice is sent. The notice and opt-out link do not verify the guardian's authority or replace required consent. Do not enter a child's information if the necessary authority or consent has not been obtained.
7. Responsibility for athlete data
The account holder — whether an organization or an individual coach — warrants that they have the necessary authority and any consents required by applicable law from athletes and their parents or guardians before entering athlete information into Sportified.
Sportified processes athlete information for the service operations and other purposes described in our Privacy Policy, including recommendation evaluation and improvement where applicable.
Where a guardian courtesy-notice feature is used, a supplied guardian email address may receive notice of the record and an opt-out link. Delivery of that notice is not guaranteed. Guardians may also request review or removal of a child's information through the responsible Organization or by contacting support@sportified.ca. An opt-out action or account deletion may not remove all related organization or historical records; broader removal may require a separate request.
Participant records may include names and identifiers, jersey numbers, positions, group and team memberships, guardian relationships, attendance, session notes and feedback, emergency contacts, and health or medical notes where the relevant feature permits them. Collect only what is necessary for your program, restrict access, and do not use general website contact forms or content-generation prompts to submit sensitive participant information. The categories and handling are described in the Privacy Policy.
Sportified and account holders each remain responsible for the privacy obligations that apply to their activities and legal roles. An account holder's responsibilities under these Terms do not remove Sportified's obligations under applicable privacy law.
8. Subscriptions and payments
Some features require a paid subscription. Web and organization subscriptions may be processed through Stripe; mobile subscriptions may be purchased through Apple App Store or Google Play and managed using RevenueCat. Fees, billing cycles, entitlements and cancellation terms are presented at purchase. Subscriptions may renew automatically unless canceled through the provider or purchase channel according to the plan terms. Taxes may apply.
Deleting an account or removing an App does not automatically cancel an externally billed subscription. Manage cancellation through the relevant billing provider or Organization administrator.
Refunds are handled according to the purchase provider, plan terms and applicable law. App-store purchases are subject to the applicable store refund process. Contact your Organization administrator or support@sportified.ca for billing questions.
9. Intellectual property
The Service, including software, design, trademarks, and documentation, is owned by Sportified or its licensors. You receive a limited, non-exclusive, non-transferable license to use the Service for your personal coaching or your Organization's authorized operations under the applicable plan or trial. PaceLabs access additionally requires the relevant contributor permissions.
You retain ownership of content you upload, subject to any rights held by its original authors or licensors. You grant Sportified the permissions needed to host, process, reproduce, display and transmit that content to operate and improve the Service, including AI features you choose to use. If you publish content through PaceLabs or share it through HQ, you authorize its availability to the audience and products permitted by that publication or sharing action.
You must have the rights needed to upload, import, adapt, attribute and publish source documents, images, video and other material. A source URL, AI-generated adaptation or attribution alone does not establish permission. Third-party content and AI output may be subject to additional rights or restrictions. Do not publish private participant or organization information as library content.
10. Offline use and data sync
The App supports offline lesson delivery and session recording. The App and supported watch features may cache session data; HQ and PaceLabs may store authoring drafts, preferences and recovery information in the browser. You are responsible for device security, protecting exports and ensuring important changes have synchronized before clearing storage or changing devices.
Sync conflicts may occur when connectivity returns. Browser drafts are not a guarantee of backup or publication. We strive to preserve data integrity but are not liable for loss caused by device failure or delayed sync, subject to applicable law.
11. Real-time and collaborative features
Game mode and multi-coach sessions rely on network connectivity and synchronized timestamps. We do not guarantee uninterrupted real-time collaboration. Coaches remain responsible for on-field supervision and decisions.
12. Third-party services
The Service uses third-party hosting, authentication, billing, analytics, AI, customer relationship management, weather and device-platform services. These include AWS, Stripe, RevenueCat, Apple, Google, PostHog, Monday.com, OpenAI and Anthropic where relevant to the feature. Your use of third-party services may be subject to their terms. Sportified is not responsible for services outside our reasonable control, subject to applicable law.
13. Privacy
Our collection and use of personal information across the App, HQ, PaceLabs and website is described in the Privacy Policy, which is incorporated into these Terms. You must comply with applicable privacy law and obtain any required consent for information you provide. Use of the Service does not substitute for consent required for optional processing or for another person's information.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT AI OUTPUTS WILL MEET YOUR REQUIREMENTS.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPORTIFIED AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
16. Indemnification
You agree to indemnify and hold harmless Sportified from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, your violation of these Terms, or your Organization's handling of athlete data.
17. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, non-payment or discontinuation of the Service. Upon termination, your right to use the Service ends. Account deletion and organization-data removal are different actions: shared organization records, published content, required billing records and backups may remain as described in the Privacy Policy. Contact support for deletion requests that are unavailable in your product, and separately cancel any external subscription. Provisions that by nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
18. Changes to the Service or Terms
We may modify the Service or these Terms. We will post updated Terms on the website and update the revision date. Bundled App Terms are updated through App releases. Continued use after changes become effective constitutes acceptance. Material changes may require additional notice where required by law.
19. Governing law and disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your jurisdiction provide otherwise.
Disputes should first be addressed by contacting support@sportified.ca. Where permitted, you agree to attempt informal resolution before pursuing formal proceedings.
20. General
These Terms, together with the Privacy Policy and any order forms or plan descriptions, constitute the entire agreement regarding the Service. If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale.
